🏛️ Court Calls Out “Overboard” Action
In a dramatic ruling, the Bombay High Court tore into Maharashtra’s Food and Drugs Administration (FDA) for suspending the license of Pune’s Gurunanak Dairy and Sweets despite a 98% compliance report. The court ordered the FDA to pay ₹5 lakh compensation within a month, calling the suspension policy “strange” and “perverse.”

Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad permitted the shop to reopen, remarking:
“Your intention is laudable… but you are going overboard. You should have immediately revoked the suspension once you noticed 98% compliance.”
💸 Losses Mount, Justice Delivered
The shop had been shut since June 12, following a food safety inspection triggered by a complaint of food poisoning. Despite submitting a compliance report and passing a re‑inspection on July 13, its license remained suspended.
The owners claimed losses of ₹8.74 lakh in revenue, forcing them to approach the High Court. The bench’s ruling not only restores their business but also compensates them for the financial damage caused by bureaucratic delay.
🏨 HC Rebukes FDA Over Hotel Case
Earlier this month, the High Court pulled up the FDA for failing to lift the suspension of Hotel Pawan Bar & Restaurant, Navi Mumbai, even after a re‑inspection confirmed 100% compliance. While restoring the license, the bench hinted at imposing costs on the department for the owner's losses.

Back in July, the HC had slammed the regulator’s “biased” approach, questioning why eateries were targeted while canteens in Mantralaya and other government establishments escaped scrutiny. The court demanded consistency and fairness in enforcement.
